These Terms & Conditions ("Terms") govern your use of the mobile application published by Cuyo LLC ("we," "us," or "our") that linked you to this page, together with its associated features and services (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
License
Subject to your compliance with these Terms, Cuyo LLC grants you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded device that you own or control, as permitted by the Apple Media Services Terms and Conditions ("Usage Rules") set forth in the App Store Terms of Service.
Description of service
Cuyo LLC develops and publishes mobile applications for iOS and other Apple platforms. The specific features, functionality, and content of the App are described on its App Store product page. Unless the App's own description or in-app disclosures state otherwise, we do not host, store, or have access to any content you create, open, or connect to using the App.
User content
You are solely responsible for any content you open, import, or connect to using the App, and for ensuring you have the right to access and use that content. We do not review or monitor user content except where the App's own features require it.
Purchases and subscriptions
The App may offer premium features, one-time purchases, subscriptions, or optional tips through Apple's In-App Purchase system (StoreKit). All purchases are processed and billed by Apple, and are subject to Apple's own terms and payment policies. Prices, features included with premium access, and availability may change over time. Purchases are non-refundable except as required by applicable law or Apple's refund policies — refund requests should be directed to Apple, not to us.
Intellectual property
The App, including its design, code, graphics, and trademarks, is owned by Cuyo LLC and protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership rights to you beyond the limited license above.
Third-party services
The App may allow you to connect to third-party sources (e.g., network shares or remote URLs) to open or access content. We are not responsible for the availability, content, or security of any third-party service you choose to connect to.
Disclaimer of warranties
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or compatible with all devices, file formats, or configurations.
Limitation of liability
To the maximum extent permitted by law, Cuyo LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the App, even if advised of the possibility of such damages. Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us, if any, for the App in the twelve (12) months preceding the claim.
Termination
We may suspend or terminate your access to the App at any time if you violate these Terms. You may stop using the App at any time by deleting it from your device.
Changes to these Terms
We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the revised Terms. We will update the "Last updated" date above when changes are made.
Governing law
These Terms are governed by the laws of Arizona, United States, without regard to conflict-of-law principles.
